# Monaco's National Council Approves 30 Day Deadline for Bank Account Appeals

Monaco's National Council unanimously approved Bill No. 1124 on October 5, setting a 30 working day window in which banks must examine an account application and request any additional documents. If a bank stays silent beyond that period, the applicant can ask the state to intervene without needing a formal rejection first.

The legislation builds on the right to a bank account introduced in Monaco in 2020, a right that had remained difficult to exercise for many individuals and businesses whose applications were neither accepted nor formally refused. The National Council noted that access to an account is essential for working, running a business and managing everyday life.

The Finance Commission trimmed the government's original 45 day proposal down to 30 working days, and reduced from 15 to 10 working days the time allowed for the Direction du Budget et du Trésor to designate an alternative bank once a bank's silence triggers the process. The bill also lets applicants start the procedure before an account closure actually takes effect, extends the right to joint account holders who have no individual account, and adds an accelerated appeal process before the Court of First Instance for cases where a designated bank also refuses. Banks retain all of their existing obligations around money laundering, terrorist financing and corruption prevention.

National Council President Thomas Brezzo welcomed a bill that ensures a proclaimed right becomes a real right. Rapporteur Karen Aliprendi stressed the need to balance banking vigilance with effective access, while Finance Minister Frédéric Cottalorda praised the collaboration between the departments involved. The bill still requires the Prince's sanction before it can be promulgated and published in the Journal de Monaco, and no implementation date has yet been announced.
